Wrongful death is not always the product of malice or ill intent. Often, a fatal car accident or personal injury resulting in death occurs out of negligence. One poor choice, one negligent mistake or one moment of distraction can lead to tragic consequences. But despite the circumstances behind an accident, those at fault often face serious consequences. Earlier this month, a 19-year-old man faced trial in Volusia County for his part in a fatal accident that claimed the lives of two young men nearly a year ago.

Car surfing was the original catalyst behind the fatal crash, but the 19-year-old driver lost control of his vehicle resulting in a rollover. The vehicle subsequently burst into flames. The two young men that passed away had been riding on the runners of the vehicle prior to the accident. The young man who was still riding on the running board of the vehicle when the rollover took place passed away at the scene while the other young man -- whom police believe was making an attempt to climb back into the vehicle -- died at Halifax Health Medical Center in Daytona Beach shortly after the accident. The 19-year-old driver and two additional passengers were taken to an area hospital.

Most of the families of those victimized in the accident did not desire that charges be pressed against the young driver, who pleaded no contest to a charge of reckless driving and two charges of vehicular homicide. However, the mother of one of the victims who lost his life believes that all those involved should be charged. The mother was tearful when she took the stand and gave indication that her grief would be lifelong.

Despite the pressure of a court room, the 19-year-old driver at fault apologized to the families of those victimized by his actions. He went on to state, "I'll try to do whatever I can to make it right." He was sentenced to one year of house arrest and an additional five years of probation. Still, his remorse over the incident may not prove enough for the mother who feels as though harsher punishment was due. She may seek to exercise additional rights provided under the umbrella of the law in the form of a wrongful death lawsuit that could further hold negligent parties accountable for their actions.
